On the morning of Tuesday, December 27th, 2016, I was in Department 7 of Humboldt County Superior Court, attending what must be the fifth or sixth preliminary hearing, spanning over 75 days, now, in the case of JV160250.

On this morning, my wife and I were introduced to the lawyer who would be representing our other three daughters - a lawyer by the name of Randall Davis.

We immediately recognized Randall Davis as the lawyer who had represented PPM, the local real estate property management firm, and the Blanchard family, owners of the property, when we had been evicted from 137 12th Street, in Fortuna, here in Humboldt County.

The eviction at 137 12th Street is a controversial one because the apartment was infested with bedbugs and mold, the property had drainage problems, and there was a foot of liquid sewage beneath the building.

The eviction at 137 12th Street is a controversial one because it is the position of my wife and myself that our daughter's suicidal depression is directly connected to the terrible conditions in which we were, as a family, forced to live, for the better part of a year ? while Humboldt County's Health & Human Services Department, ignored our pleas for help.

(This would be the same Humboldt County Department of Health & Human Services who is now trying to take our children away, because one of our children is suffering from suicidal depression, which, DHHS alleges, my wife and I caused.)

The eviction is a controversial one because we are drafting a lawsuit against PPM, and the Blanchard family, pursuant to the torts we suffered, as their tenants.

My wife and I do not understand how a lawyer with such an obvious conflict of interest towards our family, could be appointed as our children's lawyer.

My wife and I do not understand how the court could fail to be aware of this conflict - and so, following the dictum that, "Once you eliminate the impossible, whatever remains, no matter how improbable, must be the truth", my wife and I are forced towards the conclusion that this is not an accident ? but, rather, a deliberate action, on the part of someone in a position of responsibility, within the Humboldt County Superior Court administration, to provide PPM, and the Blanchard family, an advantage - by giving their legal counsel free access to our family's [allegedly] confidential court records.

Which would, of course, be a grotesque violation of judicial and legislative norms.

My wife and I are appalled that Judge Christopher Wilson, and Humboldt County Superior Court, could do such a thing.

My wife and I are appalled that Randall Davis could accept such a request from the court.


But this is not the only violation. It turns out this violation of our confidentiality has been going on, for months.

We also recognized Randall Davis as the unintroduced lawyer who had been hanging around in the courtroom, during allegedly confidential juvenile law hearings involving our children, over the past several months.

That is, during one of the early hearings, back in October of 2016, I noticed a few strangers sitting in the courtroom. I asked my lawyer, Sarah Kaber, who they were - seeing as this was supposed to be a confidential hearing - and Ms Kaber told me that they were other lawyers, and that they were privileged to sit in the courtroom even when there were hearings that did not involve them.

Based on information and belief, this privilege - to eavesdrop upon confidential matters involving juveniles - was extended to these lawyers by Judge Christopher Wilson, to whom Department 7 is assigned.

And so I ask:



I look forward to any explanation you might care to offer for these peculiar happenings.
